Professional Indemnity Insurance for Surgeons in India
Surgery is the most litigated specialty in Indian medicine — it accounted for 29% of the medical negligence cases decided by the NCDRC over a five-year period, the largest share of any specialty [1]. For surgeons the first question is not price but whether a carrier will insure your sub-specialty at all: IndusInd will not insure plastic surgeons under its doctors' policy [2], and Generali Central's product excludes plastic and cosmetic surgeons from its covered professions [3]. The second question is whether the wording follows your actual case mix, because reconstructive work is inside cover at five insurers and outside it at three [4,5,6,7,8,9,10,11]. Price is the third question, and the 1991 rate ladder that still governs it prices a surgeon at four times a physician [12][12].
What changes for a surgeon, insurer by insurer
Eligibility and carve-back positions taken from each carrier's own filed wording or product page. The cosmetic split is the single most consequential difference for a surgical practice [4,5,6,7,8,9,10,11].

1. Surgery is the most litigated specialty, and the market prices it accordingly
Of the medical negligence cases decided by the National Consumer Disputes Redressal Commission across a five-year review period, surgery accounted for 29% — the single largest share of any specialty [1]. That is not a surprise and it is not new: the 1991 all-India Market Agreement that still visibly governs public-sector pricing rated surgeons at 2.0 per mille of the annual limit against 0.5 for physicians, pathologists and radiologists, with plastic surgeons and anaesthetists at the top of the ladder on 3.0 [12][12][12].
So the premium loading is honest risk pricing rather than an upsell, and it is the least interesting thing about insuring a surgical practice. What actually varies between insurers, in ways that decide whether a claim is paid, is whether they will write your sub-specialty at all and whether the exclusions match your operating list. 2. Eligibility: two insurers will not write plastic surgery at all
Before comparing quotes, confirm the carrier will insure your sub-specialty. IndusInd, the former Reliance book, excludes plastic surgeons from eligibility entirely on its own product page [2]. Generali Central lists the professions it covers — radiologists, pathologists, general practitioners, consultants, surgeons including dentists, and anaesthetists — and states that plastic and cosmetic surgeons are not among them [3]. Generali Central also publishes no policy document at all [3], so a plastic surgeon there faces a refusal they cannot even read the basis of.
This is a genuinely unusual market feature and it goes unmentioned in every comparison we have seen. A sub-specialty that one insurer treats as uninsurable is written as routine business by the next.
The clauses a surgeon should read before comparing premiums. Each one has decided a real claim.

3. The cosmetic carve-back is the clause that decides reconstructive claims
Every Indian doctors' wording excludes cosmetic surgery in some form. What separates them is whether the exclusion carves back reconstructive work.
New India, National, ICICI Lombard, IFFCO Tokio and IndusInd exclude pure cosmesis but expressly carve back burns, trauma and scar repair. United India, Oriental and HDFC ERGO Mediserve exclude cosmetic work flat, with no carve-back at all [4,5,6,7,8,9,10,11]. For a surgeon whose list mixes reconstruction after trauma with elective aesthetic work — which describes a large share of plastic, maxillofacial and burns practice in India — the same operation is inside cover at five insurers and outside it at three.
No seller will lead with this, because it requires telling you that the policy has a hole shaped like a third of your practice. It is the first thing a surgeon should ask to see in writing.
4. Your policy has to follow your team, not just you
Surgery is performed by a team, and the wordings treat the team inconsistently.
Assistants are the clearest gap. At New India, United India, National, Oriental, ICICI Lombard, IFFCO Tokio and IndusInd, a qualified assistant is indemnified under your policy only if named in the schedule, while employed nurses and technicians are covered automatically [4,9][4,9]. Your registrar is therefore in the one category that requires a positive act of paperwork, and the trainee almost certainly does not know whether it was done — which is the subject of our guide for residents and PG students.
Anaesthesia is the other. HDFC ERGO Mediserve excludes anaesthesia not administered by a registered anaesthesiologist [11], which is prudent underwriting and a live exposure in any setting where sedation is given by someone else. All four public-sector wordings also exclude dentist-administered general anaesthesia outside a hospital.
5. Sizing the limit when defence costs come out of it
Surgical claims are fought hard and they are fought long. Insurers contested 22 of the 25 doctors' indemnity claims in our judgment sweep [19], and every Indian carrier pays defence costs from within the limit of indemnity rather than on top of it [4,15,5,10,6,11,7,8,16,17,18] — with ICICI Lombard additionally applying its excess to the legal spend [6]. Once the annual aggregate is exhausted, no carrier reinstates it [4,5,10,6,7,8].
Against that, current surgical award scale runs to ₹1.5 crore for a wrong-kidney nephrectomy [13], with the Supreme Court's benchmark quantum case at ₹11 crore [14]. The modal policy limit across the cases in our sweep was ₹10 lakh [19], and courts have made doctors personally fund the shortfall when the limit ran out [20]. A surgeon choosing a limit for premium comfort rather than award reality is choosing a slow-motion uninsured loss.
One further clause deserves attention on a surgical policy. Bajaj, Tata AIG and Go Digit carry hammer clauses [16,17,18]: refuse a settlement your insurer recommends and your cover caps at that figure plus costs to that point. In a specialty where reputation makes doctors want to fight, that clause quietly transfers the decision to the insurer.
6. What a surgeon should do
- Confirm the insurer will write your sub-specialty before you compare price [2][3].
- Get the cosmetic exclusion and its carve-backs in writing, and match them against your actual list [4,5,6,7,8,9,10,11].
- Ask which of your assistants are named on the schedule [4,9].
- Size the limit against award reality, remembering defence costs come out of it [4,15,5,10,6,11,7,8,16,17,18][20].
- Check the reporting window — 90 days is standard [4,5,10,6,7,8], zero at HDFC ERGO Mediserve [11] — and never let a renewal lapse.
- Notify in writing the day anything arrives [19].
