What Is Professional Indemnity Insurance?

Professional indemnity insurance — medical indemnity, or malpractice cover — pays the compensation and funds the legal defence when a patient alleges that your professional advice or treatment caused them harm. In India it exists because of one judgment: the Supreme Court held in 1995 that medical services are "service" under the Consumer Protection Act, which made doctors suable in consumer fora and created the market for this product [1]. Three structural facts matter more than anything in a brochure. It is claims-made, so the claim must be first made against you while the policy is live, not merely arise from treatment you gave while it was live. Its limits are expressed as an AOA:AOY pair, so the amount available for one incident may be a fraction of the annual figure. And defence costs come out of your limit at every Indian carrier we could verify — none pays them in addition [2,3,4,5,6,7,8,9,10,11,12]. It is also not an indemnity bond, which is a different document entirely [13].

1. The definition, and the judgment that created the product

Professional indemnity insurance indemnifies you against your legal liability to pay damages arising from a breach of professional duty — for a doctor, an alleged act of negligence, error or omission in treatment or advice. Two things come with it: the money to pay a compensation award, and the money to defend the allegation.

In India the product has a specific origin. In Indian Medical Association v. V.P. Shantha (1995) the Supreme Court held that medical services are "service" within the meaning of the Consumer Protection Act, making doctors suable in consumer fora [1]. That single holding built the demand. It has been under sustained challenge since 2024 — a two-judge bench doubted it while excluding advocates from the Act [23], a three-judge bench then held the reference unnecessary [24], and a fresh petition is pending [25]. Before going further, clear the terminology. In India the word "indemnity" is dominated by the indemnity bond — the undertaking signed for college admissions, licence renewals and property matters — which is not insurance and carries no cover [13].

2. How the cover actually works

It is claims-made. The policy responds to claims first made in writing against you during the policy period, arising from acts after a retroactive date. This is the opposite of the trigger most people assume. Treating a patient in 2019 while insured does not, by itself, mean a 2026 complaint about that treatment is covered — what matters is whether your cover has run continuously back past 2019. The consequence is that lapses are expensive in a way that lapses in motor or health insurance are not.

Limits come in pairs. Any One Accident caps what is available for a single incident; Any One Year caps the total for the policy year. New India publishes ratios of 1:1, 1:2, 1:3 and 1:4 for doctors [19], and IndusInd publishes the corresponding bands [20]. At 1:4, only a quarter of your headline number is available for the claim you are actually facing. National Insurance uses "Any One Occurrence" terminology for the same mechanic, which makes quotes harder to compare side by side [4].

Defence costs are inside the limit. Every Indian doctors' PI product we could verify pays defence from within the sum insured, and none pays it in addition [2,3,4,5,6,7,8,9,10,11,12]. At ICICI Lombard, Tata AIG and Bajaj the excess is applied to defence spend as well as damages [6][11][10]. New India's wording is the most generous in the market on this point, funding the defence "whether liability ultimately attaches to the policy or not" [2].

There is a window after the policy ends. Most carriers allow 90 days to report a claim after cover ends [2,4,5,6,8,9]; IFFCO Tokio's window is triggered by cancellation from either side, the broadest we found [8]; Bajaj allows 30 days and only if Bajaj itself cancels [10]; HDFC ERGO Mediserve allows none at all [7].

3. What it does not do

It does not make you un-suable, and it does not cover the criminal branch of a medico-legal crisis. Every Indian doctors' PI wording we read excludes criminal acts, and every one excludes fines and penalties [2,4,6,8,9,10] — so the proceeding that can take your liberty is the one no private policy pays for. Doctors report that a concurrent criminal case can itself trigger a private-insurer denial on the civil side, and cite it as their reason for keeping IMA scheme membership [27]. It also does not let you settle privately. Every wording requires the insurer's written consent before you admit liability, make an offer or settle, so a quiet cash settlement can leave the policy paying nothing. And it does not automatically insure your clinic: establishments are written on separate paper at most carriers [6], and Tata AIG's wording states that an entity named as Policyholder is not itself an Insured [11].

Finally, it does not guarantee that the insurer pays the patient. The NCDRC held in 2024 that PI insurers cannot be directed to pay the complainant directly at the consumer-forum stage — you pay the award and recover afterwards [28].

4. Insurance, or the IMA scheme?

Indian doctors have a second option that is not insurance at all. The IMA's Professional Protection Schemes are mutual member-contribution pools: not IRDAI-regulated, with no policyholder protections and no recourse to the Insurance Ombudsman [29,30]. They also use the opposite trigger — protection attaches to incidents occurring during active membership rather than to claims made during a policy period, and no scheme document provides any tail, so leaving or lapsing ends protection for later-filed suits about in-membership incidents [31,30,32,33].

The caps are the other difference. The national scheme protects ₹10 lakh per case and ₹20 lakh per year for a ₹3,000 first-year fee [30][30], where a private policy at ₹1 crore costs doctors a reported ₹4,000 to ₹9,000 a year [27][34]. 5. Do you need it, and what should you buy?

You need it if you treat patients under your own registration. No statute compels it [15,16], but provider agreements do [17] and doctors report it is effectively compulsory at large hospitals [18]. Trainees are not exempt from being named: complaints name every doctor involved [36], and a junior is covered under a principal's policy only if named in its schedule [2,37].

On what to buy, three questions decide more than the premium does. What is the compulsory excess and does it apply to defence costs — New India and Oriental charge none at all [2,38][5,38]. How long after the policy ends can you still report — 90 days is the norm, zero is not [7]. And is there a hammer clause letting the insurer cap its liability at a settlement you refused, as at Bajaj, Tata AIG and Go Digit [10,11,12]. What is professional indemnity insurance in simple terms?
It is insurance that pays when your professional work is alleged to have harmed someone. What is the difference between professional indemnity insurance and an indemnity bond?
They are unrelated. Professional indemnity is an IRDAI-regulated insurance contract with a premium, a sum insured and an insurer who pays. An indemnity bond is an undertaking you sign — for a college admission, a licence, a property matter — in which you accept a liability yourself. It has no premium, no insurer and no cover [13]. Searching for "indemnity" in India returns mostly the latter.
Is professional indemnity insurance the same as medical malpractice insurance?
In India, yes — professional indemnity, medical indemnity and malpractice cover all name the same product. The wordings are titled "Professional Indemnity Policy for Doctors and Medical Practitioners" or close variants, and all four public-sector versions descend from the same 1991 Market Agreement [38,2,4,5].
What does claims-made mean in an indemnity policy?
It means the trigger is when the claim is first made against you, not when the treatment happened. A claim about a 2019 operation is covered by your 2026 policy only if your cover has run continuously back past 2019 — the retroactive date. This is why a lapse is so damaging: HDFC ERGO preserves the retroactive date only on unbroken renewal [7], and Go Digit requires documentary evidence of the expiring cover before granting the back years [12]. Is professional indemnity insurance mandatory for doctors in India?
Not by law. No Indian statute or regulation mandates it for individual doctors — the NMC's 2023 conduct regulations did not require it and were themselves put in abeyance within weeks [15,16]. In practice contracts require it: TPA and network-provider agreements oblige the provider to hold and maintain cover for the term [17], and doctors report it is effectively compulsory to work at large hospitals [18]. What is not covered by professional indemnity insurance?
Criminal acts, fines and penalties are excluded by every Indian doctors' wording we read [2,4,6,8,9,10], along with practice under intoxicants, acts before the retroactive date, and — with a carrier-by-carrier split — cosmetic surgery [2,4,6,8,9,37,5,7]. Newer paper prunes more: HDFC ERGO's 2025-26 product excludes opioid liability, vaping, clinical trials, IVF and wrongful-life claims, and anaesthesia not given by a registered anaesthesiologist [7]. How much does professional indemnity insurance cost for a doctor in India?
Less than most doctors expect. Brokers publish an entry point around ₹708 a year plus GST [22], a radiologist at about ₹2,360 and a surgeon at about ₹9,440 for ₹1 crore of United India cover [39][39], and doctors report ₹1,700-2,500 for ₹1 crore on a GP profile [21]. Who needs professional indemnity insurance?
Anyone who treats patients under their own registration, including residents and junior doctors — the hierarchy does not keep your name off a complaint [36], and you are covered under a principal's policy only if you are named in its schedule [2,37]. Clinics and hospitals need separate paper; a doctor's personal policy does not insure the establishment [6][11].
